Abstract

Written by a legal contractor for the Municipality of Medellín, this article presents a legal analysis of the distribution of institutional authority over urban tree management in the city, across its various stages. The author examines the applicable regulatory framework, delineating the responsibilities among the Secretariat of the Environment, the Secretariat of Public Works, and the Aburrá Valley Metropolitan Area as environmental authority. The text explores in depth the legal controversy surrounding authority to approve pruning, felling, and relocation of urban trees, and proposes practical criteria for resolving overlapping jurisdiction, distinguishing the different legal treatment that should apply to native trees versus planted trees.
